GENERAL CONDITIONS OF USE
Read these general conditions of use as they regulate your access and use of this application (hereinafter “Application”).
Using the application means that you agree to be bound by the General Conditions of Use and undertake to comply with them. If you do not accept the General Conditions of Use terms, you cannot use the Application. If you decide not to accept said terms, please close this Application.
The Application is published by Dr. Alessandro Pini in its capacity as application publisher.
INTRODUCTION
Alessandro PINI built the VASCERN APP app as a Free app. This SERVICE is provided by Alessandro PINI at no cost and is intended for use as is.
This page is used to inform VASCERN APP visitors regarding my policies with the collection, use, and disclosure of Personal Information if anyone decided to use my Service.
If you choose to use my Service, then you agree to the collection and use of information in relation to this policy. The Personal Information that I collect is used for providing and improving the Service. I will not use or share your information with anyone except as described in this Privacy Policy.
The terms used in this Privacy Policy have the same meanings as in our Terms and Conditions, which is accessible at VASCERN APP unless otherwise defined in this Privacy Policy.
1. INTELLECTUAL PROPERTY
1.1. Ownership of Application intellectual property rights
Dr. Alessandro Pini is the exclusive owner of all intellectual property rights and/or rights of use and specifically with reference to copyright, rights on the database, rights on trade marks and rights on designs and models pertaining to services offered by the Application, especially with reference to structure (specifically graphics, information sheets and functionality) and content (specifically trade marks, images, logos, illustrations, photos, texts, etc.).
1.2. Rights of use granted to the User
Dr. Alessandro Pini grants the User non-exclusive, non-transferable and non-assignable rights of use, of the Application and of data contained therein, free of charge and for purely personal use - excluding any other use -, subject to the User’s acceptance of these General Conditions of Use.
Any amendment, improvement, editing, translation, decompilation, disassembly or creation of one or more works deriving from the Application and especially from its contents, by the User, is strictly forbidden without prior written consent from Dr. Alessandro Pini.
Any reproduction, representation and use of any nature and for any purposes, of all or part of the Application, especially of its structure and contents, without prior written consent from Dr. Alessandro Pini, is illegal and will constitute an act of counterfeiting, punishable by penal sanctions.
2. PERSONAL DATA
2.1. Declaration of personal data
Dr. Alessandro Pini certifies that no data will be archived during Application use and that no data will be conserved on the User’s terminal. The User undertakes to comply with third party rights, image rights and privacy protection rights, in compliance with applicable legislation (The General Data Protection Regulation (GDPR) (EU) 2016/679 and subsequent integrations and amendments).
In any case, you are hereby reminded that the User is fully responsible for protecting access to their own terminal, upon first use. Dr. Alessandro Pini will not be held liable for access by any unauthorised third parties to any data inserted in the User’s terminal.
3. USE OF THE APPLICATION
3.1. Purposes and contents of the Application
The purpose of the Application is to support users in identifying specialties centers.
It is hereby specified that the Application does not provide medical or diagnostic advice, nor does it promote pharmaceutical or healthcare products.
Under no circumstances will Dr. Alessandro Pini be held liable for any direct and indirect consequences deriving from decisions taken by the Medical User, pertaining to disease diagnosis and patient treatment.
4. LIABILITY
4.1. Limitation of liability
Dr. Alessandro Pini undertakes to enact all necessary measures to maintain Application accessibility for Users. It is hereby specified that Dr. Alessandro Pini will not be held liable if the User is unable to use one or more proposed services, for whatever reason. Dr. Alessandro Pini will not accept any liability in case of its inability to fulfil contractual obligations due to unforeseeable circumstances or force majeure, as defined by the law and Italian legislation. The User recognises that Dr. Alessandro Pini will not be held liable in any way and on any grounds, for all direct damages (specifically immaterial) and/or indirect damages pertaining to Application use (specifically contents, access...) suffered by the User, insofar as said User holds sole liability to this effect. Dr. Alessandro Pini reserves the right to adopt all necessary actions to guarantee perfect User compliance with own obligations.
Some links may connect to other applications, Internet websites or social networks. Dr. Alessandro Pini will not be held liable in case the content of any aforementioned applications, Internet websites or social networks does not comply with third party rights and in general with statutory provisions and legislation in force.
4.2. Assistance
Dr. Alessandro Pini does not guarantee the User with Application maintenance or assistance in use.
4.3. Updating the Application
Dr. Alessandro Pini will not be held liable in case of the User’s failure to update the Application and consequent malfunction.
4.4. Absence of warranty
Dr. Alessandro Pini does not provide any explicit or implicit warranty, nor does it undertake any liability with reference to the use of the Application or any of its contents.
5. SELECTION OF MEANS AND COSTS
The User is personally responsible for the sourcing or purchasing, the installation and maintenance of materials and/or copyright of software required for the use of the different services proposed by the Application, according to technical status upon connection.
6. GOVERNING LAW
These General Condition of Use are subject to Italian law.
7. WITHDRAWAL
These General Condition of Use will remain in force until the right of withdrawal is exercised. Said right may be exercised at any moment, upon the initiative of either the User or Dr. Alessandro Pini.
As of the moment in which withdrawal from General Conditions of Use occurs, the User undertakes to cease any use of the Application, to permanently remove and uninstall any copies of the Application.
If the User fails to comply with any one of these General Condition of Use terms, User rights will be definitively lost, without any prior notification from Dr. Alessandro Pini.
8. DECLARATION OF UNDESIRED EFFECT LINKED TO THE USE OF DRUG
The Application has not been developed for the collection of information on undesired effects. Consequently, the User is not released from warning patients about any undesired effects following the use of a drug.
